We posses a profound knowledge and experience on drafting and negotiation of IT-contracts. Our attorneys are authors to the leading Danish literature on IT-contracts - “IT-kontrakter I+II” (IT-contracts I + II), Internet kontrakter (Internet contracts) and K01 kommenteret (annotated version of standard contract for IT-procurement), all published by Thomson Information (equivalent to Sweet & Maxwell and Westlaw).
Suppliers we assist in the drafting of template documents such as terms and conditions, outsourcing, ASP, project, maintenance, support and license contracts. We further prepare guidelines for negotiations, and train sales and project teams so they are able to avoid the pitfalls of Danish law and commercial practice.
When suppliers opt to make a bid at a public tender, we often participate in the bid team where we explain the rules applicable to the tender procedures, make a legal review of the proposal and draft reservations to the customer contract contained in the tender material. As Denmark has a unique tradition for strict application of the EU-directives on public procurement, suppliers from abroad are prone to get problems, if they decide to make a bid without use of local advice.
Customers we also assist the customer side in the drafting and negotiation of all types of IT-contracts. In case of major procurements we take prime responsibility for proper conduct of the tender procedures.
